Agreement to Terms
This End User License Agreement ("EULA") is a legal agreement between you and HASTINGS LOUNGE LTD for the Hastings Lounge software product for iOS, which includes computer software and may include associated media and electronic documentation ("Software").
By installing, copying, or otherwise using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software. Your use is also governed by our Privacy Policy.
License Grant
HASTINGS LOUNGE LTD grants you a limited, non-exclusive, non-transferable, revocable license to:
- Use the Software — install and use the Software on Apple devices you own or control, subject to the App Store terms and Apple’s usage rules.
- Create a local account — optionally register credentials stored on your device to access personalized stay features.
License Restrictions
You may not:
- Copy, modify, or create derivative works of the Software.
- Reverse engineer, decompile, or disassemble the Software except where applicable law expressly permits.
- Remove, alter, or obscure any proprietary notices on the Software.
- Use the Software for any commercial purpose without authorization.
- Share account credentials in a way that violates these terms or applicable law.
- Use automated systems to scrape or abuse the Software.
- Use the Software in any unlawful manner.
Intellectual Property
The Software is licensed, not sold. HASTINGS LOUNGE LTD retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of HASTINGS LOUNGE LTD.
- We own: software code, designs, graphics, text, and other content in the application.
- You control: local preferences and account data stored on your device, subject to deletion and device backups.
User Data and Privacy
Your use of the Software is also governed by our Privacy Policy. The Software is designed for on-device storage of accounts, preferences, and stay-related state. It does not require payment or subscription information.
No Subscriptions
Hastings Lounge does not offer auto-renewing subscriptions. Any future paid features, if introduced, will be described in the App Store and in updated terms before they apply.
Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HASTINGS LOUNGE LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components. Hastings Lounge does not guarantee specific hospitality outcomes.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HASTINGS LOUNGE LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, including loss of data, business interruption, or other losses.
Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any term. Upon termination you must cease all use of the Software and delete all copies in your possession.
Updates and Modifications
HASTINGS LOUNGE LTD may provide updates, patches, or modifications to the Software. You acknowledge that the Software may require updates to continue functioning properly. We may modify this EULA; continued use after changes constitutes acceptance.
Governing Law
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which HASTINGS LOUNGE LTD operates, without regard to conflict of law provisions, except where mandatory consumer protections apply.
